What is POA or Power of Attorney?
Generally, a power of attorney is a written document authorizing someone else to act on behalf of the owner of the property. It is used when a property owner authorizes someone else to purchase, sell, lease or manage it on his or her behalf.
General Power of Attorney. This type of POA in UAE allows the individual to sell, purchase, lease or manage real estate on behalf of the principal. Additionally, this power of attorney includes the rights to represent the owner before government agencies, developers, master developers, utility companies, and so on.

Special Power of Attorney. It only allows the attorney to act for special situations and only gives them specific powers. It is commonly used for transactions which can be completed in a brief amount of time.

If the Dubai Land Department has already issued the owner's title deed, then a power of attorney for sale can be signed before a Notary Public.

A Notary Public will require a NOC from the financing bank, along with a true copy of the title deed, if the property is mortgaged (either through Islamic finance or conventional finance).

In Dubai, the owner cannot sign the power of attorney before a Notary Public if the title deed has not been issued. The owner will have to either wait for the title deed to be issued by the Dubai Land Department or sign a power of attorney in his own country and follow the legalization process there.

Moreover, if an attorney/agent appointed with a power of attorney in Dubai does not possess a UAE residence visa, the power of attorney may not be accepted for registering an Ejari.
